Service Agreement

Agreement – This agreement legally binds you (“Customer”) and Dumpsters Near Me (“DNM”) to the conditions listed below and in accordance with the laws of the State of Florida in effect at the time of signing this agreement. DNM agrees to provide Customer with non-hazardous solid waste collection, transportation, disposal and recycling services.

Service — Customer agrees to give DNM at a one (1) business day notice for service (dumpster delivery, exchange, final pick-up, or relocation). If a call for service is received after 12:00 PM noon, DNM cannot guarantee available service for the next business day. DNM is not responsible for unforeseen delays that could impact servicing your needs – such as: inclement weather, traffic conditions, etc.

Blocked Dumpster — If DNM attempts to deliver or pick up a dumpster and the dumpster is blocked or a gate is locked or prevented in any way from delivering or picking up a dumpster the Customer will be charged a $150 ““No Service”” fee for dry run. Boom of truck is raised approximately 15’high, so please make sure any tree branches, cables, or power lines are not in the way of desired location of dumpster.

Prohibited Waste — Customer agrees not to put any hazardous or toxic waste in the dumpster since it is against the law. Any and all hazardous or toxic waste found in the dumpster will become the responsibility of the Customer. At DNM’s discretion, DNM may return or leave the hazardous or toxic waste found in the dumpster and charge the Customer a $150 Return fee. At DNM discretion, DNM may charge Customer a disposal fee for the hazardous or toxic waste found in the dumpster as detailed below in Disposal Fee Chart. Hazardous or toxic waste includes: industrial waste, waste containing asbestos, septic tanks & waste, paint, cleaning solutions, biomedical waste, pesticides, solvents, automobiles, automobile parts, tires, oil, oil filters, oil containers, gas cans, propane tanks, batteries of any kind, appliances with Freon (air conditioners, refrigerators, etc.), Freon aerosol cans, foam aerosol cans, electronics (TV’s, computers, monitors, computer parts, radios, etc.), hazardous waste (ballasts with PCBs, devices containing mercury, fluorescent bulbs, etc.); please also keep food trash and landscape debris out (unless all you are dumping is landscape debris).

Disposal Fees — At DNM discretion, DNM may charge Customer, and Customer agrees to pay, a disposal fee for the hazardous or toxic waste found in the dumpster as follows:

Food Trash-Mixed $50/ton
Florescent Bulbs $25 each
Paint Cans (with paint) $20 each
Car Batteries $40 each
Propane Tanks $50 each
Oil Cans $25 each
Freon Aerosol Cans $100 each
A/C Compressors $200 each
Window A/C $200 each
TV, Computer, Monitor $25 each
Any Small Electronic Equipment $25 each
Vacuum Cleaner $50 each
Refrigerator (large) $200 each
Refrigerator (small) $100 each
Any Other Large Appliance $50 each
Car Tires $25 each
Truck Tires $50 each

Equipment — All equipment furnished by DNM shall remain the property of the company, however Customer shall have care, custody, and assume control of the equipment and shall bear responsibility and liability for all loss or damage to the equipment and for its contents while at Customer’s location. Customer shall not move or alter the equipment (paint) and shall use the equipment only for its intended purpose. Customer shall provide unobstructed access to the equipment on the scheduled pick-up day. DNM is NOT responsible for any damage done to Customer’s property, including walkways, lawn, landscaping, curbing, pavement, driveways, pavers, irrigation, wells, septic or underground utilities resulting from the company’s provision of services. It is recommended paver driveways are protected by plywood you may purchase at home improvement stores in sheets of 4’ x 1’. Customer warrants that the right of way is sufficient to bear the weight and physical dimensions of the DNM equipment and vehicles. Customer understands that lawn damage may occur during a construction/clean-up project. No repair is offered or provided.

Overfilled Dumpsters — Customer agrees not to over-fill the dumpster beyond the “Max Load Line” indicator painted on the top rail of the dumpster. An over-filled dumpster cannot be tarped and may allow debris to fall out and damage other cars and trucks and it is against the law to transport an over-filled dumpster. DNM reserves the right to refuse to pick up an over-filled dumpster. If over-filled, the Customer will be responsible for removing over-filled debris down to the “Max Load” fill line. An additional charge to the Customer of a $150 No Service fee will apply.

Overweight Dumpsters — DNM reserves the right to refuse to pick-up a dumpster with an estimated weight in excess of 18,000 pounds (9 tons). If overweight, the Customer will be responsible for removing debris down to less than 18,000 pounds (9 tons). An additional charge to the Customer of a $150 No Service fee will apply.

Extra Tonnage — Customer agrees to pay for any overage tonnage charges (by rate specified on county location page) than that which is specifically included with the dumpster size rented. The additional weight (rate/ton) will be billed via original payment method (credit card) used initially to rent the dumpster. The local landfill within customer’s municipality weighs each load dumped, giving us an exact weight for each dumpster rented.

Commercial Charges — Commercial locations are charged an additional amount indicated on each county’s page.

Out of Area Charges — Certain cities within larger counties may be subject to out of area charges, as indicated on county page parameters. This is an additional charge incurred and specified by location.

Daily Rental — Each dumpster rental includes a number of fourteen days in the rental, which is listed on the website and in the email confirmation sent to the Customer. If the dumpster is emptied & returned, the next dumpster is considered a new rental and the billing cycle restarts- including the same number of days as the first dumpster rented.

Cancellation — The Customer may cancel rental at any time, however is subject to a $25. cancellation fee, if before 3PM on day they book rental. If customer cancels after this, they are subject to a ‘dry run’ charge of $150.

Indemnity — The Customer fully agrees to indemnify, defend, and save DNM harmless from and against any and all liability which DNM may be responsible for or pay out as a result of bodily injuries (including death), property damage or any violation or alleged violation of the law to the extent caused by Customer’s breach of this Agreement or by any negligent omission or willful misconduct of the Customer or its employees, agents, or contractors in the performance of this agreement. Neither party shall be liable to the other for consequential, incidental, or punitive damages arising out of or in connection with the performance or non-performance of this agreement.
